My name is Michael. I operated Seattle's largest photo booth service company from roughly 2015-2019.In 2019, we made Inc 500's list of fastest growing companies in America.Then... COVID.I'm starting over post-pandemic with a brand new company.I bought the domain TBDphotobooth.com as a joke a while back, because I needed a website and didn't have a company name.After booking my first several events, people told me to keep it. My friends told me TBD doesn't mean "To be determined..." it means "The Best Damn" photo booth company. 😄It's the most important event of your life, and you deserve The Best Damn photo booth company!

IntroductionThese Terms and Conditions ("Agreement") govern the provision of photo booth services by TBD Photo Booth, LLC ("Provider"), a Washington LLC, to the client ("Client"). By booking and using the services provided by the Provider, the Client agrees to the following terms:II. Services ProvidedSetup and Operation: The Provider will be responsible for the delivery, setup, operation, and removal of the photo booth. A qualified technician will be present to manage the photo booth during the event.Limitations: All services to be provided must be discussed in writing and included on the invoice. Any expectations or promises of services not explicitly mentioned by the Provider in writing and listed on the invoice will not be included in the services provided.III. Event DetailsThe Client is responsible for providing accurate and complete details regarding the event, including the Event Date, Event Address, and Photo Booth Start Time. The Provider will rely on this information to schedule and deliver the services. Any changes to the event details must be communicated to the Provider as soon as possible and may be subject to availability and additional fees.IV. Payment TermsTotal Fee: The total cost for the photo booth services will be detailed on the Invoice plus applicable taxes.Deposit: A non-refundable deposit of 50% of the total fee is required to secure the booking. This deposit includes a non-refundable fee of $300. In the event of cancellation by the Client, any amount paid over $300 will be refunded, if the cancellation occurs more than 30 days before the Event Date.Balance Payment: The remaining balance must be paid no later than 30 days before the Event Date. After this date, all payments become non-refundable.Overtime Charges: Any additional time beyond the scheduled hours will be billed at $175 per hour. No refunds will be issued if the event ends earlier than expected.Returned Payments: The Client may be charged $50 or the maximum amount permitted by law for each returned check.Date Changes: Requests to change the event date must be made in writing and are subject to availability. A new agreement may be required for any date changes, and both parties must agree in writing.Taxes: All applicable taxes will be applied to the total fee and communicated at the time of booking.Service Failure: In the unlikely event that the Provider is unable to provide a fully operational photo booth, the Client will be entitled to a full refund. No further claims or damages will be entertained. If only partial services are delivered due to circumstances beyond the Provider's control, the fee may be adjusted on a prorated basis.V. Additional TermsSpace and Access Requirements: The Client must ensure that the event venue provides adequate space (8’ x 8’ floor area) and power supply (electrical outlet within 25 ft.) for the photo booth. The Provider will provide specific requirements that must be met.Ownership of Media: The Provider retains full ownership of all photos and media created during the event and reserves the right to use these photos for marketing and promotional purposes.License for Personal Use: The Client will receive all media files with a license for personal use (social media, printing, framing, etc.). If the Client wishes to obtain exclusive or commercial rights to the media, these rights may be purchased separately.Equipment Damage: The Client is responsible for any damage or loss of the Provider’s equipment caused by the Client or their guests. The Provider reserves the right to cease operations if the event environment is deemed unsafe due to inclement weather or other conditions, with no refund provided.Liability and Indemnification: The Provider shall not be liable for any direct, indirect, incidental, or consequential damages, including lost profits or increased expenses, related to the services provided. The Client agrees to indemnify and hold harmless the Provider and associated personnel from any claims or legal fees arising from the event unless caused by the Provider’s negligence.VI. Governing LawThese Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which the event takes place.VII. Entire AgreementThese Terms and Conditions constitute the entire agreement between the Provider and the Client. Any modifications or amendments must be made in writing and agreed upon by both parties.By booking and utilizing the Provider’s photo booth services, the Client acknowledges and agrees to these Terms and Conditions.
